Terms & conditions

Version of 10 August 2026 — Plyx workshop management software.

1. Definitions

For the purposes of these general terms and conditions:

« Plyx » or the « Publisher »: the Plyx workshop management software and its publisher, Lorry Dupont, registered with the Belgian Crossroads Bank for Enterprises under number 0643.672.796 (VAT BE 0643.672.796), with registered office at Avenue Baron Seutin 14, 1410 Waterloo, Belgium.

The « Platform »: the website www.plyx.be, the online application available at plyx.be/app, the related public pages (including online appointment booking) and the services they contain, hosted by OVH SAS (2 rue Kellermann, 59100 Roubaix, France) on servers located in the European Union.

The « User »: any natural or legal person who visits the Platform.

The « Customer » or the « Garage »: any legal or natural person acting exclusively for professional purposes who takes out a Subscription to the Services. The Services are reserved for professionals; they are not offered to consumers.

The « Subscription »: the contract under which the Customer accesses the Services for the chosen duration and plan (monthly, quarterly or yearly).

The « Services »: all the features offered by Plyx, described in Article 4.

The « Customer Data »: all data entered into the Platform by or on behalf of the Customer, including data relating to its own customers (the « End Customers »), their vehicles, and its commercial and accounting documents.

The « Authorised Users »: the members of the Customer's staff to whom the Customer has granted access to the Platform.

The « T&C »: these general terms and conditions.

2. Legal notice

Pursuant to Article III.74 of the Belgian Code of Economic Law, the following legal information is provided to the Customer:

Price: see Article 7.

Nature of the economic activity: Plyx is workshop management software (DMS) offered online, on a subscription basis, to garages and automotive professionals.

3. Scope and enforceability

The T&C govern access to the Platform and the provision of the Services by Plyx to the Customer. They apply to the exclusion of all other terms, including any general terms and conditions of the Customer.

The Services are intended exclusively for professionals acting in the course of their business. The Customer warrants that it subscribes for professional purposes; the legal provisions specific to consumers do not apply.

Plyx reserves the right to amend the T&C at any time. Amendments are notified to the Customer (by e-mail or via the Platform) at least 30 days before they take effect. Continued use of the Services after that date constitutes acceptance; failing agreement, the Customer may terminate its Subscription before the amendments take effect, termination taking effect at the end of the period already paid for.

Any subscription implies that the Customer acknowledges having read and accepted the T&C, without any reservation.

4. Description of the Services

Plyx is complete management software for workshops: customer and vehicle records, workshop planning, repair orders, quotes and offers, invoicing (including the issuing of structured electronic invoices via the Peppol network), the legal repair register, the reporting of mileages and works to Car-Pass, management of the parts inventory and of the used-vehicle stock, online appointment booking, accounting exports, AI-assisted features (including the reading of photographed documents and the decoding of chassis numbers), and any other feature presented on the Platform.

This list is indicative: the Services evolve. Plyx may add, modify or remove features, provided the essential characteristics of the Services are not substantially reduced during a period already paid for.

Some features rely on third-party services (in particular: the Peppol network via an accredited access point, Car-Pass, vehicle data providers, e-mail services, artificial intelligence models). Plyx is not liable for interruptions or changes imposed by these third parties, but endeavours to limit their effects and, where applicable, to offer an alternative.

The results produced by the artificial intelligence features (document reading, suggestions, decoding) are provided as data-entry assistance: the Customer verifies them before use. They constitute neither advice nor data guaranteed to be accurate.

5. Account, access and security

Access to the Services requires an account. The Customer designates its Authorised Users and manages their access; each e-mail address may correspond to only one account on the Platform.

Credentials are personal. The Customer ensures their confidentiality and is liable for any use of the Services made through the accounts of its Authorised Users. It informs Plyx without delay of any unauthorised use.

Plyx implements appropriate security measures (encrypted communications, protected access tokens, logging, encrypted backups). As no system is infallible, the Customer remains responsible for the quality and accuracy of the data it enters.

6. Subscription, demonstration and refusal

Subscription takes place with the Publisher (online or by direct contact), who configures the Customer's access. A demonstration environment or period may be offered; demonstration data may be deleted at any time.

Plyx reserves the right to refuse a subscription or suspend an account for legitimate reasons (including, but not limited to: a dispute with the Customer relating to payment, any fraudulent payment or attempted payment, use contrary to the T&C), including after the subscription has been registered. It informs the Customer by e-mail.

7. Price

The price of the Subscription depends on the chosen plan (monthly, quarterly or yearly) and the options taken out (in particular the artificial intelligence plans). Prices are expressed in euros excluding VAT — the Services being reserved for professionals.

Certain services are billed per use, in addition to the Subscription, at the rate in force at the time of consumption: in particular document readings by artificial intelligence beyond the subscribed plan and chassis number decodings. This usage is summarised and invoiced in arrears, per calendar quarter.

The price list in force is communicated to the Customer upon subscription and on request. Plyx reserves the right to change its prices at any time; any change is notified to the Customer at least 30 days before it applies and only applies to periods not yet paid for. The price of a period already paid for is never changed.

8. Invoicing and payment

Subscriptions are invoiced in advance, at the start of each period. Usage-based services (Article 7) are invoiced in arrears, per calendar quarter.

Invoices are sent electronically (where applicable as structured electronic invoices via the Peppol network). Unless otherwise stated on the invoice, they are payable within 15 days.

Any invoice unpaid at its due date bears, by operation of law and without notice, late-payment interest at the rate provided for by the Belgian Act of 2 August 2002 on combating late payment in commercial transactions, as well as a fixed compensation of €40 for recovery costs, without prejudice to other costs actually incurred.

If non-payment persists eight days after a formal notice has remained without effect, Plyx may suspend access to the Services until full payment. Suspension does not release the Customer from paying the amounts due and does not entail any deletion of Customer Data.

9. Duration, renewal and termination

The Subscription is concluded for the duration of the chosen plan and is tacitly renewed for successive periods of the same duration.

Either party may terminate the Subscription at any time, in writing (by e-mail or via the Platform). Termination takes effect at the end of the current period; amounts paid for that period remain due and no pro-rata refund is owed, except in the cases provided for in Articles 3 and 7.

Plyx may terminate by operation of law, without compensation and after a formal notice has remained without effect for fifteen days, in the event of a serious breach by the Customer (in particular: persistent non-payment, unlawful use of the Platform, breach of its security).

The effects of the end of the contract on Customer Data are governed by Article 11 (reversibility).

10. Availability, maintenance and support

Plyx provides the Services with care and skill, under an obligation of means. Plyx aims for high availability but does not guarantee uninterrupted access: interruptions may result from maintenance, updates, or failures of the host, the network or third-party services.

Planned maintenance is, as far as possible, carried out outside workshop business hours. The Platform also includes an offline mode allowing most work to continue during an outage, with data synchronising once the connection is restored.

Support is provided via the Platform and by e-mail, on business days. Plyx continuously monitors the status of its services and intervenes as quickly as possible in the event of an incident.

Plyx is not liable for temporary unavailability of the Platform, for technical failures not attributable to it, or for offences committed by third parties through the Platform (in particular the transmission of viruses, against which Plyx takes every measure).

11. Customer Data, data protection and reversibility

11.1. Ownership

Customer Data remains the exclusive property of the Customer. Plyx uses it only to provide the Services and neither sells it nor discloses it to third parties, except for subcontractors necessary for the provision of the Services and legal obligations.

11.2. Roles under the GDPR

For the personal data of End Customers entered into the Platform, the Customer is the data controller and Plyx acts as processor within the meaning of Article 28 of the GDPR. A data processing agreement concluded between the parties specifies the subject matter, duration, nature and purposes of the processing, the categories of data, the security measures and the sub-processors. The Customer warrants that it has a legal basis for the data it enters and is responsible for informing its End Customers.

11.3. Hosting and security

Customer Data is hosted in the European Union. It is regularly backed up, encrypted, and stored at a location separate from the production server. Documents and photographs uploaded by the Customer are stored outside the public area of the site and served under access control.

11.4. Reversibility and deletion

Throughout the duration of the contract, the Customer may export its data via the Platform's export functions (in particular in CSV/Excel, UBL and PDF formats). At the end of the contract, for whatever reason, Plyx keeps a full export of the Customer's Data available for 30 days; after that period, Customer Data is deleted from the active systems, then from the backups according to their rotation cycle, subject to statutory retention obligations. However, transmissions already made to third-party registers (in particular Car-Pass and the Peppol network) are irreversible.

12. Legal obligations of the Garage (Car-Pass, Peppol, register)

The Platform enables the Customer to perform certain legal obligations (reporting of mileages and works to Car-Pass, issuing of structured electronic invoices, keeping of the repair register). These transmissions are made in the name and on behalf of the Customer, on the basis of the data it has entered: the Customer remains solely responsible for their accuracy, completeness and timeliness. Plyx is not liable for the consequences of erroneous data entered by the Customer, nor for the decisions of third-party bodies (refusals, corrections, sanctions).

13. Terms of use of the Platform

The following provisions apply from the first visit to the Platform. By visiting it, the User irrevocably agrees to the terms of use set out below.

Access conditions

Use of the management application is reserved for the Customers' Authorised Users. The public pages (showcase site, online appointment booking) are accessible to any User. The User undertakes not to use the Platform in a manner incompatible with these terms or with applicable laws and regulations. A User guilty of unlawful use is solely responsible for the consequences, and Plyx reserves the right to suspend access.

Prohibited practices

The Platform may under no circumstances be used to transmit, display, distribute, store or destroy material:

  • infringing any applicable law or regulation;
  • infringing copyright, trademarks, trade secrets or other intellectual property rights of others, or violating the privacy or other personal rights of others;
  • whose content is defamatory, obscene, threatening, abusive or hateful.

It is also prohibited to breach or attempt to breach the security of the Platform, including, but not limited to: accessing data not intended for the user or logging into a server or account the user is not authorised to access, as punishable under Articles 550bis and 550ter of the Belgian Criminal Code; performing scans or probes or testing the vulnerability of a system or network, or breaching security or authentication measures without appropriate authorisation; attempting to disrupt the service to any user, host or network.

Intellectual property

The general structure of the Platform, as well as its content, texts, graphics, images, sounds and videos, together with the Plyx software itself, its code, its databases and its documentation, are the intellectual property of the Publisher and are protected in particular by copyright. The Subscription grants the Customer a personal, non-exclusive and non-transferable right to use the Services, for the duration of the contract and for the needs of its business — it entails no transfer of rights. Any representation and/or reproduction and/or exploitation, in whole or in part, of the content and services offered by the Platform, by any means whatsoever, without the prior written authorisation of the Publisher, is strictly prohibited. Customer Data, however, remains the property of the Customer (Article 11).

With the exception of search engine indexing, no part of the Platform may be reproduced, transmitted or stored on another website or in any other form of electronic system without prior authorisation, including copies made via robotic technologies of the « Robot/Crawler » type or any other automatic mechanism.

Use of cookies

The Platform uses cookies and similar technologies (including the local storage required for the application's offline operation). The cookies used serve to operate the Platform (« technical cookies ») and, where applicable, to compile statistics (« analytics cookies »). The data collected is under no circumstances passed on to third parties for commercial purposes. The User may accept or refuse non-technical cookies and may disable them at any time by following the instructions of their browser.

14. Documents and files uploaded to the Platform

The Customer may attach documents and photographs to the Platform's records (registration certificates, parts, working documents). It warrants that it holds the necessary rights to this content and is responsible for its lawfulness; Plyx exercises no prior control and disclaims all liability for its content.

Documents photographed for reading by artificial intelligence (registration certificates, supplier order sheets) are processed and then immediately deleted: they are not retained by Plyx.

Uploaded files are stored and backed up with the Customer Data, within the storage quota attached to the Subscription. They are returned and deleted under the conditions of Article 11.4.

15. Liability

Plyx is bound by an obligation of means. Its liability may only be incurred in the event of proven fault and is limited, for all damages combined and per contract year, to the total amount paid by the Customer during the twelve months preceding the event giving rise to liability.

Plyx is not liable for indirect damage, including loss of turnover, loss of custom, erroneously entered data or damage to image, nor for damage resulting from: (i) non-compliant use of the Services, (ii) inaccurate data entered by the Customer, (iii) a failure of the Customer's networks, hardware or software, (iv) a third-party service referred to in Article 4.

The Customer remains solely responsible for compliance with its own accounting, tax and legal obligations; the Platform is a tool and is no substitute for an accountant or an adviser.

Nothing in these terms excludes or limits Plyx's liability in the event of fraud, gross negligence or personal injury.

16. Force majeure

Neither party is liable for a failure caused by an event of force majeure (in particular: widespread power or network outage, major failure of the host, large-scale cyberattack, decision of an authority, natural disaster). Obligations are suspended for the duration of the event; if it exceeds 60 days, either party may terminate without compensation, with paid periods not provided then being refunded pro rata.

17. Privacy — personal data

The data collected is used by Plyx in accordance with its personal data processing policy and with the European and national data protection laws applicable in Belgium. Processing carried out on behalf of Customers is governed by Article 11.

18. Jurisdiction — applicable law

For any question or difficulty, the Customer is invited to contact Plyx, which will always favour the amicable resolution of disputes.

These T&C are governed by Belgian law. Any dispute relating to their validity, interpretation or performance falls under the exclusive jurisdiction of the courts of the judicial district of Walloon Brabant.

Should any clause (or part of a clause) of these general terms and conditions be declared null or unenforceable, all other provisions remain in force and the disputed clause or part shall be replaced by a provision coming as close as possible to the underlying intention of the annulled clause or part.
